Case description:

Darío He had been completing his obligatory military service for six months, enduring extremely harsh conditions. While out on pass, he had taken to sea with some neighbors in a rustic vessel attempting to flee Cuba. Five days later, after a terrible ordeal at sea, they were rescued by the U.S. Coast Guard and returned to Cuba. After several days in a hospital, he was returned to Cienfuegos province and imprisoned for deserting his military service. He was kept in isolation and transferred to a punishment cell, incommunicado; several days later, authorities reported he had hung himself with a sheet. Yet, prisoners are not allowed sheets or garments in punishment cells. He left a 15 year-old wife and a one-month old daughter.
U.S.-Cuba migration agreements call for Cuba to respect the physical and emotional integrity of anyone intercepted at sea and repatriated by the U.S.

Cumplía el servicio militar obligatorio hacía seis meses bajo condiciones extremadamente duras. En su primera salida, con unos vecinos intentó huir de Cuba en una pequeña embarcación. Luego de cinco terribles días en el mar, fueron rescatados por la Guardia Costera de Estados Unidos y devueltos a Cuba. Después de estar varios días en un hospital, Darío fue encarcelado por desertar de su servicio militar, incomunicado y puesto en aislamiento en una celda de castigo. Pocos días más tarde, las autoridades informaron que se había ahorcado con una sábana a pesar de que a los prisioneros no se les permiten sábanas o prendas algunas en las celdas de castigo.
