José was on "conditional liberty" for a four-year prison sentence for "social dangerousness." He was speaking with two foreign tourists when a National Revolutionary Police agent asked him for identification. Afraid of the police, he ran to a building in Bernaza Street and climbed to the roof, trying to jump onto another building's roof, but falling from a third floor. Agüero Corzo hablaba con dos turistas extranjeros cuando un agente de la Policía Nacional Revolucionaria le pidió identificación. Temeroso de la policía, corrió a un edificio en la calle Bernaza y subió al tejado, intentando saltar al techo de otro edificio, pero cayendo de un tercer piso. Su madre afirmó que debido a que era un no-conformista, no había recibido atención médica rápidamente.
