Case description:

Executed with two friends for "acts of terrorism" after hijacking the 45 ft. ferry Baraguá in Havana Bay and taking the passengers hostage. Armed with one pistol and several knives, they had sought to escape to the U.S. and request political asylum.
The ferry had run out of fuel in the high seas (Florida Straits). Chased by two Cuban Coast Guard patrol boats, the hijackers were persuaded to return and they agreed to have the ferry towed 30 miles back to Cuba's Mariel port for refueling. There, they were captured after a French hostage (female tourist) jumped into the water at the urging of a government diver. 
The summary trial began almost immediately, the three were sentenced to death while eight others accused as accomplices received varying prison sentences. The appeal was heard, but the death sentence had not been not been ratified when, without warning, they were executed. At 5AM the families were notified they had been killed and told to go to the cemetery immediately for the burial. 
It transpired that the Supreme Court and the Council of State had upheld the appeal even though the hijackers had caused no injuries to passengers or damage to the vessel. The execution took place just nine days after the hijacking and the same week that 75 dissidents were sentenced to long prison terms (up to 28 years). 
Eight friends or family members accused of participating in the hijacking were sentenced to varying prison terms (from 3 years to life): Maikel Delgado Aramburu, Iovany Tomás González, Harold Alcalá Aramburu, Ramón Herry Grillo, Wilmer Lidia Pérez, Yolanda Pando Rizo, Rosa Lidia Ríos and Dania Rojas Góngora.
The Inter-American Commission on Human Rights described in detail the absence of numerous due process guarantees and denounced the "extremely summary proceedings" as well as the resulting arbitrary deprivation of life.
Cuba's citizens are forbidden by law to leave the country without government permission. The Cuban Penal Code criminalizes piracy (as “stealing, capturing, or taking possession of a vessel or airplane, deviating it from its route or interfering in its normal operations, or endangering the safety of the same) and sentencing guidelines stipulate imprisonment for 10 to 20 years or death, although the court may reduce sanctions by two thirds for attempts or preliminary actions.
A group of Cuban intellectuals including Alicia Alonso, Miguel Barnet, Leo Brouwer, Pablo Armando Fernández, Eusebio Leal, Silvio Rodríguez, Amaury Pérez, Chucho Valdés, Cintio Vitier, and Omara Portuondo published a letter in support of the executions.

Ejecutado junto a dos amigos por "actos de terrorismo" tras secuestrar el ferry de 45 pies Baraguá (que viajaba desde el puerto de Regla al puerto de La Habana en la bahía de La Habana) y tomar como rehenes a los pasajeros. Armados con una pistola y varios cuchillos, habían buscado escapar a Estados Unidos y solicitar asilo político.
El ferry se había quedado sin combustible en alta mar (Estrecho de Florida). Perseguidos por dos lanchas patrulleras de la Guardia Costera cubana, los secuestradores fueron persuadidos de que regresaran y acordaron que remolcaran el ferry 30 millas de regreso al puerto cubano del Mariel para repostar. Allí, fueron capturados después de que una rehén francesa (turista) saltara al agua a instancias de un buzo del gobierno.
El juicio sumario comenzó casi de inmediato, los tres fueron condenados a muerte mientras que otros ocho acusados ??como cómplices recibieron diversas penas de prisión. Se escuchó la apelación, pero la sentencia de muerte no había sido ratificada cuando, sin previo aviso, fueron ejecutados. A las 5 de la mañana se notificó a las familias que habían sido asesinadas y se les dijo que fueran al cementerio de inmediato para el entierro. Trascendió que la Corte Suprema y el Consejo de Estado habían confirmado la apelación a pesar de que los secuestradores no habían causado heridos a los pasajeros ni daños a la embarcación. La ejecución tuvo lugar apenas nueve días después del secuestro y la misma semana en que 75 disidentes fueron condenados a largas penas de prisión (hasta 28 años). Ocho amigos o familiares acusados ??de participar en el secuestro fueron condenados a distintas penas de prisión (de 3 años a cadena perpetua): Maikel Delgado Aramburu, Iovany Tomás González, Harold Alcalá Aramburu, Ramón Herry Grillo, Wilmer Lidia Pérez, Yolanda Pando Rizo, Rosa Lidia Ríos y Dania Rojas Góngora.
La Comisión Interamericana de Derechos Humanos describió en detalle la ausencia de numerosas garantías del debido proceso y denunció los "procesos sumamente sumarios" así como la consiguiente privación arbitraria de la vida.
Los ciudadanos de Cuba tienen prohibido por ley salir del país sin permiso del gobierno. El Código Penal cubano tipifica como delito la piratería (como “robar, capturar o apoderarse de una embarcación o avión, desviarlo de su ruta o interferir en sus operaciones normales, o poner en peligro la seguridad del mismo) y los lineamientos de sentencia estipulan penas de prisión de 10 a 20 años o muerte, aunque el tribunal puede reducir en dos tercios las sanciones por tentativas o acciones preliminares.  Un grupo de intelectuales cubanos entre los que se encontraban Alicia Alonso, Miguel Barnet, Leo Brouwer, Pablo Armando Fernández, Eusebio Leal, Silvio Rodríguez, Amaury Pérez, Chucho Valdés, Cintio Vitier y Omara Portuondo publicó una carta en apoyo de las ejecuciones.
